Our mission is to enable transparent, secure, and impactful crowdfunding for individuals and communities in need. The Platform offers the following services ("Services"):
1.1.1 Fundraising Services
Users seeking financial support can initiate a fundraising campaign ("Campaign") on the Platform. The roles within our ecosystem are defined as follows:
Campaigner: A user initiating a fundraising campaign, which may include individuals, family members, verified NGOs, or educational/medical institutions.
Donor / Funder: A user contributing financially or materially to a fundraising campaign.
Visitor: A user who is browsing the platform without creating an account or making a transaction.
1.1.2 Fund Collection and Disbursement
Funds on the Platform are collected and disbursed through two separate mechanisms:
INR Donations: Processed via Indian financial partners like Razorpay, Cashfree, and other RBI-compliant Payment Aggregators. These contributions are collected and disbursed to Campaigners in accordance with Indian laws and regulatory frameworks.
Foreign Donations: Contributions in foreign currencies are processed through FCRA-compliant channels or registered intermediary NGOs holding a valid FCRA certificate. Foreign donations are handled strictly in accordance with the Foreign Contribution (Regulation) Act, 2010.
Indian and foreign funds are collected, processed, and disbursed separately to ensure compliance with financial and legal regulations.
Campaigners may list specific non-cash items (medicines, school kits, food packages, etc.) for which donors can contribute monetarily. SocialAngel, through verified procurement partners or associated NGOs, procures the goods and delivers them directly to the beneficiary.
1.1.4 Add-On Services & Benefits:
To support medical fundraisers, SocialAngel may offer:
Free teleconsultations
Assistance with hospital admissions
Legal and claims support for insurance
Discounted diagnostic and pharmacy services
Micro-insurance or emergency health coverage (subject to campaign amount thresholds and third-party T&Cs)
Eligibility for these benefits depends on the amount raised by the campaign and may be subject to change. Users will be informed via email or campaign dashboard.
1.1.5 Verification & Fraud Prevention
SocialAngel makes every reasonable effort to verify the authenticity of campaigns, including reviewing submitted documents, calling references, and conducting background checks where necessary. However:
We do not guarantee that 100% of funds are used exactly as stated by the Campaigner.
We are not legally liable for the misuse of funds.
We urge Donors to report suspicious campaigns using the "Report" feature.
Upon receiving a complaint, our internal compliance team will investigate and take action, including pausing or terminating the campaign, blocking payouts, or informing appropriate authorities.
User Content Submissions
2.1 Ownership and Responsibility
Users may submit various forms of content to the Platform including text, images, audio, video, documents, campaign descriptions, testimonials, updates, and other materials (collectively referred to as "User Content"). By submitting such content, you affirm that:
You are the sole and rightful owner or have been granted explicit rights to use and share the content.
Your User Content does not infringe on any intellectual property rights, privacy rights, or other legal rights of any third party.
Your submission is accurate, lawful, and does not contain harmful, fraudulent, or misleading information.
2.2 License to SocialAngel
By uploading or posting User Content to the Platform, you grant SocialAngel Services Private Limited a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, publicly display, adapt, and modify such content solely for the purpose of operating, promoting, and improving the Platform and our Services.
2.3 Prohibited Content
Users are prohibited from uploading, posting, or otherwise sharing any User Content that:
Is obscene, defamatory, libelous, or promotes hatred or violence.
Contains nudity, pornographic material, or sexually explicit content.
Infringes upon the copyright, trademark, or intellectual property of others.
Violates the privacy rights of individuals (e.g., unauthorized medical records).
Contains harmful code, malware, or viruses.
Misrepresents the purpose of a campaign or impersonates another individual or organization.
2.4 Monitoring and Moderation
SocialAngel reserves the right to review, edit, reject, remove, or disable access to any User Content that we, in our sole discretion, find violates this policy or applicable laws, without prior notice. However, we are not obligated to do so and assume no responsibility for any User Content shared on the Platform.
2.5 Reporting Infringement
If you believe that any User Content on the Platform infringes your rights or violates these terms, you may notify us at legal@socialangel.org. We will investigate the matter and take appropriate action in accordance with our policies and applicable laws.
Acceptance of Terms
3.1 By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use, along with our Privacy Policy and any other guidelines or policies referenced herein.
3.2 If you are using the Platform on behalf of a business, organization, or other legal entity, you represent that you have the authority to bind such entity to these Terms.
3.3 If you do not agree to these Terms, you must refrain from using the Platform or any of the Services provided by SocialAngel.
3.4 Continued use of the Platform constitutes acceptance of any modifications made to these Terms of Use from time to time.
Modification of Terms of Use
4.1 SocialAngel reserves the right to revise, amend, or update these Terms of Use at any time, without prior notice. Any changes will be effective immediately upon posting the revised Terms on the Platform.
4.2 Users are encouraged to review the Terms periodically to stay informed of any updates. Continued use of the Platform after such changes signifies your acceptance of the modified Terms.
4.3 If you do not agree to the revised Terms, you must immediately stop using the Platform and terminate your account if applicable.
Registration
5.1 To access certain features of the Platform, such as creating or contributing to a fundraising campaign, Users must create an account by providing accurate, current, and complete information.
5.2 Users agree to update their account details as necessary to maintain accuracy. SocialAngel is not responsible for any consequences resulting from outdated or incorrect information.
5.3 Users are responsible for maintaining the confidentiality of their login credentials. Any activity that occurs under your account will be deemed your responsibility. You agree to notify SocialAngel immediately of any unauthorized use of your account.
5.4 SocialAngel reserves the right to suspend or terminate your account if we believe the information you provided is false, misleading, or violates these Terms.
Fund Transaction and Accountability
6.1 SocialAngel facilitates the transfer of funds between Donors and Campaigners and provides visibility into the amounts collected and disbursed. However, SocialAngel is not a banking or financial institution and does not hold funds in escrow.
6.2 All transactions on the Platform, including donations, are processed by third-party payment service providers (such as Razorpay, Digio, Cashfree, or other regulated payment gateways) authorized by SocialAngel. Users agree to comply with the terms of such providers.
6.3 Campaigners must use the funds received only for the purposes outlined in their respective campaigns. Any deviation must be notified to and approved by SocialAngel, and failure to do so may result in suspension of the campaign and legal action.
6.4 Donors understand and agree that:
All donations are voluntary and non-refundable.
SocialAngel does not guarantee that funds will be used as promised by the Campaigner.
SocialAngel is not liable for any misuse of funds but will take necessary action upon receiving credible reports or evidence.
6.5 Campaigners must provide updates to donors on the use of funds when requested and cooperate with SocialAngel during audits or reviews.
6.6 In the event of unresolved disputes between Donors and Campaigners, SocialAngel reserves the right to withhold disbursal, initiate refunds (where legally permitted), or escalate the matter to appropriate authorities.
Social-Kart Services
7.1 SocialAngel offers Campaigners an option to raise funds for in-kind contributions through its Social-Kart feature. This allows Donors to support campaigns by funding specific products or services instead of donating cash.
7.2 SocialAngel or its authorized procurement partners will be responsible for purchasing the listed goods or services on behalf of the Donor and delivering them to the Campaigner or beneficiary.
7.3 All goods provided under Social-Kart are:
Subject to availability
Purchased from verified vendors
Delivered within estimated timelines based on supplier location and logistics.
7.4 SocialAngel will make all efforts to procure and deliver the selected items. However, in case of unavailability, alternate items of equivalent value may be offered or the funds may be used for general campaign purposes after informing the donor.
7.5 Donors opting for Social-Kart contributions acknowledge that these are non-refundable and that SocialAngel is not responsible for manufacturing defects or warranty claims, which must be resolved with the manufacturer.
Credit Information and Lending Services
8.1 SocialAngel does not currently provide credit or lending services directly to Users.
8.2 In the future, we may collaborate with regulated financial institutions or NBFCs to offer:
Microloans for verified Campaigners,
Advance payouts for urgent causes,
Pre-approved health or education loans linked to fundraisers,
Buy-now-pay-later (BNPL) services for medical or essential needs.
8.3 All such financial services will be provided under applicable laws and require prior consent and KYC verification of the User. Terms and conditions, interest rates, and repayment policies will be transparently disclosed if and when such features are introduced.
8.4 Until such offerings are available, Users are advised not to consider SocialAngel as a lender, loan facilitator, or financial advisory entity.
Declarations
9.1 By accessing or using the Platform, Users declare and affirm the following:
(a) You are of legal age (18 years or older) and possess the legal authority to enter into a binding contract;
(b) You will use the Platform only for lawful purposes and comply with all applicable laws and regulations;
(c) You will not post, promote, or support any campaign that involves fraudulent or illegal activity, misrepresentation, or violation of third-party rights;
(d) All information provided during registration, campaign creation, or donations is true, accurate, and current to the best of your knowledge;
(e) You acknowledge that donations are voluntary and final, and SocialAngel is not liable for refund requests unless legally mandated;
(f) You understand and agree that funds raised must be used strictly for the purpose stated in the campaign, and misuse may result in legal consequences;
(g) You acknowledge that SocialAngel reserves the right to terminate accounts or campaigns that violate the Terms of Use, Privacy Policy, or any applicable law;
(h) You will not impersonate another individual or misrepresent your identity, relationship to a beneficiary, or the authenticity of any campaign.
9.2 These declarations form the foundation of trust within the SocialAngel ecosystem and violation of any of the above may lead to permanent suspension of user accounts or legal action.
Terms & Conditions for Campaigners
10.1 Users who initiate fundraising campaigns on the Platform ("Campaigners") must comply with the following terms in addition to the general Terms of Use:
10.2 Campaigners shall provide accurate, verifiable, and complete information while registering campaigns. SocialAngel reserves the right to request additional documentation for verification and due diligence.
10.3 Campaigns must be lawful and must not include or promote:
Illegal or unauthorized fundraising,
Hate speech or discriminatory content,
Pornographic, violent, or misleading materials,
Content that infringes on the rights of others.
10.4 SocialAngel reserves the right to:
Approve or reject a campaign based on its discretion,
Modify or take down content in violation of these terms,
Request campaigners to edit, clarify, or provide proof for claims made.
10.5 Campaigners shall:
Clearly define the goal, use of funds, timelines, and intended beneficiaries,
Use the funds raised solely for the stated purpose,
Notify SocialAngel in writing if any material change occurs in the situation of the beneficiary, campaign goals, or funding requirements,
Cooperate fully with any audit or post-campaign verification,
Be liable for any legal or regulatory breach arising out of the campaign.
10.6 SocialAngel may withhold disbursement of funds:
Until all KYC and verification requirements are satisfied,
If credible complaints arise regarding misuse or fraud,
If the campaign violates any law, regulation, or SocialAngel policy.
10.7 Campaigners agree that they may be publicly named on SocialAngel's Platform and communications for transparency. Anonymous campaigns are allowed only upon review.
10.8 In the event of a dispute between co-campaigners, beneficiaries, or third parties, SocialAngel may, at its discretion, pause fundraising and disbursement until the matter is resolved.
10.9 Campaigners will indemnify SocialAngel from any claims arising out of their campaign, including but not limited to defamation, misappropriation, or fraud.
10.10 Breach of these obligations may lead to permanent suspension of campaigner accounts, legal action, and forfeiture of any unpaid donations.
Campaign Marketing
11.1 SocialAngel may offer promotional support to campaigns, including but not limited to featured listings, homepage placement, email marketing, and social media promotions.
11.2 Campaigners may request marketing support, subject to approval. Support may be provided:
At the discretion of the SocialAngel editorial team,
Based on impact potential, urgency, or cause relevance,
As part of premium services, sponsored promotions, or editorial features.
11.3 Campaigners agree that SocialAngel may:
Edit or reframe campaign content for branding and consistency,
Use campaign visuals, videos, and testimonials for internal or external communications,
Include campaign highlights in case studies, blogs, press releases, and newsletters.
11.4 Campaigners must obtain permissions and rights for all media (photos, videos, testimonials) submitted or used in campaigns. SocialAngel shall not be liable for copyright or intellectual property violations.
11.5 Paid advertising or influencer collaborations initiated by SocialAngel will be disclosed in accordance with applicable digital marketing regulations.
11.6 Campaigners who independently promote their campaigns must:
Represent SocialAngel accurately,
Avoid exaggerated or misleading promotional tactics,
Comply with platform branding guidelines if using SocialAngel's name or logo.
11.7 SocialAngel may provide marketing performance reports to Campaigners on request, showing metrics such as views, reach, engagement, and conversions.
11.8 Any disputes or concerns related to campaign marketing must be raised with SocialAngel within 7 working days of the incident.
Campaigner Email Database
12.1 SocialAngel may collect donor email addresses during the course of a fundraising campaign for the purposes of:
Sending receipts and donation confirmations,
Providing updates related to the campaign,
Promoting similar causes or campaigns,
Delivering newsletters and platform updates.
12.2 Campaigners may request access to the list of donors who have contributed to their campaign, including email addresses and names, subject to donor consent and applicable data protection laws.
12.3 Campaigners must:
Use donor data only for campaign-related updates or thank-you messages,
Not sell, transfer, or misuse the donor list for personal or third-party marketing,
Provide donors with an option to opt out from further communication.
12.4 SocialAngel retains the right to review or restrict Campaigners' access to donor information if any misuse or breach of trust is suspected.
12.5 All donor data remains the property of SocialAngel and is subject to the terms of our Privacy Policy and applicable data protection laws.
Reporting
13.1 SocialAngel encourages transparency and accountability from all Campaigners. Campaigners are expected to share regular updates with donors and SocialAngel regarding the status and progress of the campaign.
13.2 Campaigners are advised to:
Provide updates at major milestones (e.g., goal achieved, beneficiary recovered, funds disbursed).
Include photos, videos, bills, or receipts wherever applicable.
Ensure language used in reports is respectful, clear, and fact-based.
13.3 SocialAngel may require periodic reporting, especially for campaigns receiving significant public attention or high-volume donations.
13.4 Failure to report or share updates may result in:
Withholding of undistributed funds,
Temporary suspension of the campaign,
Rejection of future campaigns,
Legal action in cases of suspected fraud.
13.5 Donors may also submit a report or concern regarding the misuse of funds, misrepresentation of facts, or lack of transparency via:

Financial Transaction Facility – Campaigner
14.1 SocialAngel provides an online payment gateway and wallet facility through integrated third-party service providers (such as Razorpay, Cashfree, and Digio) to enable the donation process.
14.2 Campaigners agree to provide valid KYC (Know Your Customer) documentation as required under law or by our financial partners before receiving any funds.
14.3 SocialAngel shall remit funds raised to the designated Campaigner's bank account post-deduction of:
Platform fees (if applicable),
Payment gateway charges,
Applicable taxes (such as GST or TDS),
Other administrative fees, if any.
14.4 Campaigners shall:
Ensure that the beneficiary's bank account is active, valid, and capable of accepting electronic funds transfers,
Take full responsibility for ensuring the correct beneficiary details are submitted,
Be liable for any delays or failures arising from incorrect or incomplete beneficiary data.
14.5 SocialAngel may hold back or reverse transactions in the event of:
Chargebacks,
Reported fraud,
Suspected misuse,
Violation of Terms of Use or applicable law.
14.6 Campaigners understand that payment processing times may vary depending on the financial institution, volume of donations, or verification delays.
Fund Management
15.1 SocialAngel shall act as a technology intermediary and facilitator for donations. We do not manage, invest, or lend funds on behalf of any Campaigner or donor unless explicitly stated.
15.2 Once a donation is received, the funds are either held temporarily in a nodal account or settlement account with our payment partner, pending due diligence, or directly transferred to the verified Campaigner's account post-verification.
15.3 For medical or emergency campaigns, SocialAngel may disburse payments directly to the service provider (e.g., hospital, pharmacy, school, etc.) if requested by donor or beneficiary.
15.4 Campaigners agree not to use the funds for personal enrichment, gambling, or unlawful activities. Funds should be strictly used as per the stated campaign objective.
15.5 Unused funds after campaign closure may either be:
Returned to the donor (in special cases, at SocialAngel's discretion),
Redirected to another verified campaign or social cause,
Used for administrative and platform development purposes, subject to donor notification.
15.6 In case of suspected misuse, SocialAngel reserves the right to:
Freeze funds,
Initiate an audit,
Report to law enforcement,
Recover disbursed funds,
Blacklist the user or campaign permanently.
Foreign Funds
16.1 SocialAngel facilitates collection and disbursement of international donations through authorized foreign exchange partners and compliant banking channels.
16.2 Donations made in foreign currencies (e.g., USD, EUR, GBP) may be:
Processed via international payment gateways or wire transfers,
Subject to conversion charges, intermediary bank fees, and applicable taxes,
Settled into an FCRA-compliant bank account if the campaigner is an FCRA-registered NGO.
16.3 Campaigners receiving foreign funds must:
Be registered under the Foreign Contribution (Regulation) Act (FCRA),
Provide valid FCRA license and bank account details,
Comply with all reporting and utilization guidelines of the Government of India.
16.4 Individual campaigners or non-FCRA entities are prohibited from receiving foreign donations unless routed through a compliant partner (such as a verified NGO).
16.5 SocialAngel will not be responsible for:
Delays caused by foreign exchange regulations or intermediary banks,
Campaigners failing to meet compliance requirements,
Refund requests initiated due to regulatory restrictions.
16.6 Donors contributing from abroad must ensure they meet their local country's regulations regarding international donations and tax compliance.
16.7 SocialAngel reserves the right to refund or reject foreign donations that are non-compliant, suspicious, or exceed legal limits as defined under applicable Indian or international laws.
Taxation / Donations / Contributions
17.1 Donations made on SocialAngel may be eligible for tax exemption under applicable sections of the Income Tax Act (e.g., Section 80G), provided the beneficiary NGO is registered under such exemptions.
17.2 It is the campaigner's responsibility to:
Upload and update valid 80G, 12A, or other relevant documents,
Disclose whether donations are eligible for tax deductions,
Issue proper tax receipts where applicable.
17.3 Donors may claim tax benefits only if the donation is made to a registered NGO with tax-deductible status. SocialAngel will not issue tax certificates on behalf of individual campaigners or unregistered entities.
17.4 SocialAngel will make best efforts to tag fundraisers with tax-benefit status accurately, but final eligibility lies with the beneficiary and their documentation.
17.5 Donors are advised to consult their financial advisors or legal consultants regarding eligibility for exemptions and tax filing.
17.6 SocialAngel disclaims any responsibility for:
Errors in tax documentation submitted by campaigners,
Misuse of funds claimed as tax-deductible,
Rejection of exemption claims by tax authorities.
17.7 All parties must comply with the Income Tax Act, FCRA (where applicable), and other applicable tax and fundraising regulations.
Use of Funds
18.1 All funds raised on the SocialAngel platform must be used strictly for the purpose stated in the fundraising campaign.
18.2 Campaigners agree to:
Use funds responsibly and transparently,
Maintain receipts, invoices, and financial records to demonstrate utilization,
Share periodic updates and fund usage reports with donors and SocialAngel, as required.
18.3 Misuse or misappropriation of funds is strictly prohibited. In such cases, SocialAngel may:
Suspend or terminate the campaign,
Report the matter to regulatory authorities,
Recover disbursed funds through legal remedies.
18.4 SocialAngel may conduct random audits or request detailed utilization statements to ensure funds are used appropriately.
18.5 Campaigners are also encouraged to:
Post campaign closure summaries,
Share impact stories and beneficiary updates,
Remain available for any post-campaign inquiries.
18.6 Failure to comply with fund utilization obligations may affect eligibility for future campaigns or fundraising privileges on the Platform.
Anti-Money Laundering (AML) Policy
19.1 SocialAngel Services Private Limited is committed to maintaining the highest standards of compliance with applicable anti-money laundering (AML) laws and regulations in India and any other jurisdiction from which donations may originate.
19.2 In accordance with the Prevention of Money Laundering Act, 2002 (PMLA), and associated rules, SocialAngel implements internal controls and monitoring systems to detect and prevent suspicious activities.
19.3 The platform may undertake the following measures to mitigate money laundering risks:
Conduct Know Your Customer (KYC) checks on Campaigners before disbursing funds.
Collect and verify identity and address proof of all Campaigners, including PAN, Aadhaar, government-issued ID, or organizational documents for NGOs.
Review the nature and purpose of each campaign to detect inconsistencies or red flags.
Flag and report unusual donation patterns or suspicious transactions (e.g., unusually large donations, frequent small donations from unrelated sources, cross-border donations without justification).
Suspend or terminate accounts involved in suspected or confirmed money laundering activities.
Cooperate with financial institutions, auditors, and law enforcement agencies for further investigation and compliance.
19.4 SocialAngel reserves the right to reject, hold, or refund any donation or disbursement that appears to violate AML policy, without any obligation to disclose the rationale publicly.
19.5 All users, donors, and campaigners are expected to comply with applicable AML regulations, and SocialAngel shall not be liable for any legal or regulatory consequences arising from user actions that violate these policies.
Know Your Customer (KYC)
20.1 SocialAngel has implemented a robust Know Your Customer (KYC) process to ensure the legitimacy of campaigners and donors, enhance transparency, and comply with legal regulations.
20.2 KYC documentation is mandatory for all individuals and organizations that:
Initiate a fundraising campaign,
Request fund disbursement,
Represent a beneficiary or NGO,
Collect foreign funds through the platform.
20.3 Required KYC documents may include:
For individuals: Government-issued ID proof (e.e., PAN, Aadhaar, Voter ID), address proof, recent photograph.
For NGOs/Trusts: Registration certificate, 80G/12A/FCRA license (if applicable), PAN card, bank details, authorized signatory ID proof.
20.4 All documents submitted will be subject to verification by the SocialAngel compliance team. Incomplete, invalid, or forged documents will result in disqualification or freezing of the campaign.
20.5 Fund disbursement will not occur until KYC verification is successfully completed.
20.6 SocialAngel reserves the right to request additional KYC documentation at any time and refuse or suspend a campaign if KYC compliance is not met.
20.7 All user data shared during the KYC process will be stored securely and used only for verification and legal compliance purposes, in accordance with our Privacy Policy.
Project Completion
21.1 Campaigners are expected to keep funders and the platform updated about the status and progress of their campaign, especially once the fundraising goal is reached or the project is underway.
21.2 Upon completion of the campaign objective (e.g., surgery completed, student admitted, relief work executed), the Campaigner must:
Submit a final report or summary of how funds were used;
Upload or share relevant proof (e.g., bills, discharge summary, photos);
Communicate with donors via platform updates or direct messages (if applicable);
Respond to queries from donors or the SocialAngel support team.
21.3 If the project is not completed as described or is abandoned, the Campaigner must:
Notify the platform with reasons;
Offer refunds where feasible, or;
Request platform assistance in reallocating the funds to a verified alternate campaign (with consent of donors).
21.4 Failure to provide closure or transparency post-campaign may lead to:
Blacklisting from the platform;
Legal action if donor funds are suspected to be misused;
Withholding of any future fundraising activity by the Campaigner.
21.5 SocialAngel may independently verify project completion through random audits, beneficiary checks, or third-party reports.
Campaign Rewards
22.1 In certain campaigns, Campaigners may offer rewards to donors as a gesture of appreciation for their support. These rewards are optional and at the discretion of the Campaigner.
22.2 Any reward promised must:
Be clearly listed in the campaign description;
Not violate applicable laws or platform policies;
Be delivered in a timely and transparent manner.
22.3 The responsibility of fulfilling rewards lies solely with the Campaigner. SocialAngel does not manage, track, or guarantee the delivery or quality of campaign rewards.
22.4 If rewards are not delivered as promised, donors may report the campaign to SocialAngel, and appropriate action (including campaign suspension or blacklisting) may be taken after internal review.
22.5 Campaigners must bear any shipping, packaging, or delivery costs for rewards unless specified otherwise in the campaign.
22.6 Rewards must not be construed as financial returns or investments. They are symbolic in nature and do not imply any ownership, dividend, or interest in the project or entity.
Campaign Branding & Marketing
23.1 SocialAngel may, at its discretion, offer promotional and branding support for selected campaigns, especially those with high urgency, public interest, or strong credibility.
23.2 Campaigners may be invited to:
Participate in SocialAngel-led promotional initiatives;
Allow their campaign to be featured on the homepage, newsletters, or social media;
Share testimonials, videos, or updates for platform-wide outreach;
Use approved SocialAngel branding assets (logos, banners) for external promotion.
23.3 Campaigners are permitted to create and distribute their own marketing material, provided they:
Do not misrepresent facts or exaggerate the cause;
Do not misuse or modify the SocialAngel brand, logo, or tagline;
Do not promise financial returns or mislead the public;
Abide by all advertising and data protection laws applicable.
23.4 Any co-branding, paid advertising, or influencer collaboration must be pre-approved by SocialAngel.
23.5 Campaigners must not engage in spam, fake news, or unethical promotional tactics. If such behavior is reported and verified, Social Angel may take disciplinary action including campaign suspension or legal recourse.
23.6 SocialAngel reserves the right to withdraw marketing support from any campaign at its sole discretion, without assigning a reason.
Campaign Cancellation
24.1 A Campaigner may request cancellation of their campaign at any point before funds have been disbursed. To initiate cancellation, the Campaigner must submit a written request to SocialAngel, stating valid reasons and providing supporting evidence, if applicable.
24.2 If the campaign has already received donations, the following conditions apply:
All donations will be refunded to the original donors, subject to deduction of any applicable transaction charges and taxes.
If refund is not feasible (e.g., anonymous donor, expired payment window), funds may be reallocated to similar verified campaigns upon platform discretion.
Refunds may take up to 10–15 business days to reflect in donor accounts.
24.3 SocialAngel reserves the right to cancel a campaign at its sole discretion without prior notice if:
The campaign violates the Terms of Use, community guidelines, or applicable laws;
Fraud, misrepresentation, or false information is detected;
The Campaigner is found to have engaged in suspicious or unethical practices;
Regulatory instructions or legal orders require such action.
24.4 In the event of cancellation initiated by SocialAngel:
All disbursable funds will be frozen until the investigation concludes;
Donations may be refunded or redirected as per donor instruction or platform policy;
The Campaigner will be notified of the reason for cancellation and may submit a written appeal with clarifications within 7 working days.
24.5 Repeated cancellations or misuse of campaign privileges may result in blacklisting of the Campaigner and denial of access to future fundraising services on the platform.
24.6 SocialAngel is not liable for any damages, loss of opportunity, or reputational harm arising from campaign cancellation.
Archival of Fundraising Campaigns
25.1 SocialAngel reserves the right to archive any fundraising campaign under the following circumstances:
The campaign has successfully completed its goal and funds have been disbursed.
The campaign period has expired without reaching its target.
The Campaigner has requested closure of the campaign.
The campaign was found to be in violation of platform policies or legal regulations.
25.2 Once archived:
The campaign page will no longer accept donations.
It will be marked as "Closed" or "Archived" on the platform.
Visitors may still view the campaign for reference or reporting but with restricted interaction.
25.3 Archived campaigns may be reactivated only upon formal request from the Campaigner and subject to verification and approval by Social Angel.
25.4 SocialAngel may retain data related to archived campaigns for compliance, reporting, and platform analytics, in line with our privacy policy.
Rights of the Company
26.1 SocialAngel Services Private Limited reserves the sole and absolute right to:
Modify, suspend, or terminate any part of the platform or services without prior notice;
Reject, approve, or remove any campaign that violates its policies or legal requirements;
Enforce compliance through platform-level actions such as freezing accounts, withholding funds, or legal escalation;
Conduct audits, verifications, or inspections of any campaign or user activity on the platform;
Determine the eligibility of Campaigners or campaigns for special features or marketing support.
26.2 SocialAngel may:
Develop and deploy proprietary algorithms to detect fraud or inconsistencies;
Collaborate with government bodies, regulators, or financial institutions to share campaign or transaction data, as required by law;
Create internal policies and frameworks to govern the quality, safety, and credibility of campaigns.
26.3 The company's decisions on platform matters, campaign approvals, fund disbursements, or account actions shall be final and binding. Appeals may be considered on a case-by-case basis but do not guarantee reversal.
26.4 SocialAngel may update or change its policies, procedures, and terms at its discretion. Continued use of the platform implies acceptance of these changes.
Third-Party Sites
27.1 The Platform may contain links to external websites, services, or platforms operated by third parties ("Third-Party Sites"). These links are provided solely for convenience and reference.
27.2 SocialAngel does not control, endorse, or assume responsibility for the content, privacy practices, or terms of use of any Third-Party Sites. Accessing such websites is done entirely at the user's risk.
27.3 Users are advised to read and understand the privacy policies, terms and conditions, and user agreements of any Third-Party Sites they visit or interact with.
27.4 SocialAngel shall not be held liable for any loss, damage, claim, or dispute arising out of or in connection with the use of or reliance on any content, goods, or services available through Third-Party Sites.
27.5 The inclusion of any link does not imply endorsement by Social Angel or its affiliates.
Terms and Conditions for Funders
28.1 Funders ("Donors") are individuals or entities who contribute financially to a campaign hosted on the SocialAngel platform.
28.2 By making a contribution:
You acknowledge that your donation is voluntary and non-refundable.
You understand that the funds will be transferred to the Campaigner or beneficiary in accordance with the stated use of funds.
You agree not to demand any product, service, or equivalent consideration in exchange unless explicitly stated in the campaign (e.g., rewards).
28.3 Funders are responsible for ensuring the accuracy of information provided during the donation process, including payment details and personal contact information.
28.4 Funders have the option to remain anonymous to the public, but SocialAngel may still collect and use their personal information for verification, compliance, or communication purposes as described in the Privacy Policy.
28.5 SocialAngel does not guarantee the success, credibility, or outcome of any fundraising campaign. Funders are encouraged to conduct due diligence before contributing.
28.6 SocialAngel shall not be held responsible for any misuse of funds by Campaigners or beneficiaries. However, in cases of reported fraud or misconduct, the platform may investigate and take appropriate actions.
28.7 Funders may receive updates about the campaign's progress from the Campaigner or SocialAngel, but these updates are not guaranteed.
28.8 Donations made on the platform may not always qualify for tax exemption. It is the responsibility of the Funder to verify the eligibility of the donation with respect to applicable laws and obtain the necessary receipts.
28.9 For recurring donations or subscriptions, the Funder authorizes SocialAngel and its payment partners to auto-debit the specified amount on the agreed frequency, until canceled by the Funder.
Project Completion
29.1 Campaigners are expected to update the platform and donors upon the successful completion of their fundraising goal and use of funds.
29.2 SocialAngel may require documentary evidence, photographs, testimonials, or financial statements to confirm project outcomes before disbursing the final portion of funds or archiving the campaign.
29.3 Funders are not entitled to a refund in case the project fails to meet its intended goals, unless otherwise agreed or if a violation of Terms has been proven.
29.4 SocialAngel encourages transparency and community engagement. Campaigners are urged to publish project results publicly on their campaign pages.
29.5 In cases of delayed or failed project completion, Campaigners must notify SocialAngel and their Funders, providing reasons and estimated timelines for resolution.
Rewards Delivery
30.1 If a Campaigner offers rewards to donors as part of their fundraising campaign, it is the Campaigner's sole responsibility to fulfill such rewards within the promised timeline.
30.2 SocialAngel is not responsible for the creation, distribution, quality, or delivery of rewards. All obligations rest solely with the Campaigner.
30.3 Donors acknowledge that delays or changes in the nature or timing of rewards may occur. These do not entitle the Donor to a refund unless explicitly guaranteed in the campaign.
30.4 Campaigners must keep donors informed of changes or delays and provide updates until reward delivery is completed.
30.5 In cases of repeated complaints or failure to deliver rewards, SocialAngel may take action including but not limited to freezing remaining campaign funds, restricting campaign visibility, or blacklisting the Campaigner.
30.6 SocialAngel may assist in mediation between Donors and Campaigners but does not guarantee resolution or compensation.
Refund
31.1 Donations made on the SocialAngel platform are voluntary and final. Donors understand and agree that once a donation is made, it is non-refundable unless:
A duplicate or erroneous transaction is clearly identified and proven;
The campaign is found to be fraudulent, cancelled before disbursal, or in breach of Terms of Use;
Refund is approved by SocialAngel in special cases based on platform investigation.
31.2 All refund requests must be submitted in writing to support@socialangel.org within 7 calendar days of the donation date.
31.3 Refunds will be processed only through the original mode of payment and may take up to 10–15 working days depending on the payment gateway, bank, or card provider.
31.4 In certain situations where donor identity cannot be verified (e.g., anonymous donations or expired card), the refund may be withheld and redirected to verified campaigns of similar cause, subject to donor's consent if available.
31.5 Transaction charges, taxes, or currency conversion fees incurred during the original payment may be non-refundable depending on the terms of the payment provider.
31.6 SocialAngel reserves the right to decline refund requests that are inconsistent with platform policy or made after fund disbursal.
Dispute Between Campaigners and Their Funders
32.1 SocialAngel encourages Campaigners and Funders to communicate transparently to resolve any issues. Funders may contact the Campaigner directly using provided channels or request platform mediation.
32.2 In case of unresolved disputes:
SocialAngel may mediate discussions and request documentation from both parties.
The platform may temporarily withhold funds or hide campaign visibility pending investigation.
Final decisions on dispute resolution will be based on the submitted evidence, adherence to platform policies, and compliance with legal obligations.
32.3 SocialAngel is not legally liable for any losses, damages, or liabilities arising from disputes between Campaigners and Funders. However, it will make reasonable efforts to ensure fair treatment and mitigate fraudulent behavior.
32.4 The campaign's performance history, resolution behavior, and platform compliance will influence future eligibility of the Campaigner to raise funds.
32.5 Dispute records may be retained by SocialAngel for a minimum of 24 months for audit and reference purposes.
Financial Transaction Facility
33.1 SocialAngel facilitates the collection and transfer of funds through third-party payment service providers, including but not limited to Razorpay, Cashfree, Paytm, Digio, and banking partners.
33.2 Users making payments on the platform agree to comply with the terms and conditions and privacy policies of these third-party providers.
33.3 SocialAngel does not store or process card/bank account credentials. All sensitive financial information is handled by the payment gateway's secure systems.
33.4 The platform may use APIs and plugins from financial technology service providers to process KYC verification, collect donations, issue refunds, or generate financial reports.
33.5 Donations made via credit card, debit card, UPI, net banking, or wallets will be processed securely and subject to authorization by the issuing bank/payment provider.
33.6 SocialAngel shall not be liable for any payment failures, chargebacks, or delays arising from the payment gateway or bank services. Users must contact the relevant financial service provider for resolution.
33.7 In cases of suspicious or fraudulent transactions, SocialAngel reserves the right to suspend payment processing, request additional information, or report the matter to legal authorities.
33.8 SocialAngel provides transaction records and receipts through email or downloadable links. These serve as proof of donation/payment and should be retained by the User for reference or tax purposes.
33.9 The user understands that the Financial Transaction Facility is merely a technology service and does not create any contractual relationship between the User and the payment processor beyond that defined by such third-party terms.
Representations and Warranties
34.1 By using the platform, you represent and warrant that:
You are at least 18 years of age and have the legal capacity to enter into a binding agreement;
You will not use the platform for any illegal or unauthorized purposes;
All information provided to SocialAngel, whether during registration or campaign creation, is truthful, complete, and accurate to the best of your knowledge;
You have the authority and rights necessary to operate a fundraising campaign and to use any content you post on the platform;
Your use of the platform does not violate any applicable law, regulation, or third-party rights.
34.2 Campaigners specifically warrant that:
The purpose of the campaign is genuine and the funds will be used only for the stated objectives;
You will provide timely updates and responses to platform requests for verification, reporting, or compliance;
You will not mislead, defraud, or misrepresent your intent, credentials, or outcomes;
You will comply with all tax and legal obligations related to fundraising.
34.3 SocialAngel makes no representations or warranties, express or implied, regarding the platform's accuracy, availability, completeness, or uninterrupted operation.
34.4 The platform is provided "as is" and "as available" without any warranties of any kind. SocialAngel disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Covenants
35.1 Users agree to comply with all applicable local, state, national, and international laws and regulations while using the platform.
35.2 Campaigners covenant not to misrepresent the purpose of a campaign, use false identities, or impersonate any other individual or entity.
35.3 Donors agree that contributions made to a campaign are voluntary and are not made in exchange for any goods or services, unless specifically stated in the campaign description.
35.4 Users shall not exploit the platform to disseminate spam, malware, or other malicious content.
35.5 Campaigners shall cooperate fully with any compliance checks or audit inquiries initiated by SocialAngel to verify campaign legitimacy.
35.6 Users agree not to create or manage multiple accounts for fraudulent purposes or for circumventing platform rules.
35.7 Campaigners and Donors agree not to engage in or encourage illegal activity, hate speech, discrimination, or any form of abusive conduct while using the platform.
General Terms and Conditions
36.1 These Terms constitute the entire agreement between you and SocialAngel with respect to the use of the platform, superseding any prior agreements.
36.2 If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
36.3 No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
36.4 SocialAngel may assign or transfer its rights and obligations under these Terms without restriction. You may not assign or transfer your rights without prior written consent.
36.5 The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
36.6 The failure of SocialAngel to enforce any right or provision shall not constitute a waiver of such right or provision.
Termination
37.1 SocialAngel reserves the right to suspend or terminate any user account at its sole discretion if it determines that the user has violated any part of these Terms, is engaged in fraudulent activity, or poses a risk to the platform's integrity or security.
37.2 Users may also choose to deactivate or delete their account by sending a written request to the platform.
37.3 Upon termination:
All rights granted to the user shall cease immediately;
Access to the platform and any associated services will be revoked;
Any remaining funds associated with an active campaign may be frozen pending investigation or refunded to donors where appropriate;
SocialAngel shall not be held liable for any loss incurred due to such termination.
Warranty Disclaimer
38.1 SocialAngel provides its services and the platform on an "as is" and "as available" basis, without any warranties or conditions of any kind, whether express or implied.
38.2 SocialAngel makes no warranties or representations about the accuracy, reliability, completeness, or timeliness of the content or services provided through the platform.
38.3 SocialAngel disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
38.4 SocialAngel does not guarantee the availability, reliability, or security of the platform or its services at all times.
38.5 Users use the platform at their own discretion and risk. Any material downloaded or obtained through the platform is done at the user's own discretion and risk, and users are solely responsible for any damage to their computer systems or loss of data that may result.
Content and License
39.1 By submitting, posting, or displaying content on or through the SocialAngel platform (including but not limited to campaign descriptions, testimonials, images, and videos), you grant Social Angel a worldwide, non-exclusive, royalty-free, transferable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in connection with the operation and promotion of the platform.
39.2 You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to publish content you submit and to authorize SocialAngelto use it as described in these Terms.
39.2 You retain all ownership rights in the content you submit, post, or display on or through the platform.
39.4 You agree not to submit content that:
Is defamatory, libelous, obscene, pornographic, abusive, or offensive;
Infringes upon any third-party intellectual property rights;
Contains false or misleading statements;
Violates any laws or regulations;
Harms or threatens the safety or integrity of any person or the platform.
39.5 SocialAngel reserves the right, but is not obligated, to remove or disable access to content that violates these terms or is deemed harmful, inappropriate, or objectionable.
39.6 Users may request the removal of their own content by contacting support@socialangel.org, subject to compliance, audit, or archival obligations.
Intellectual Property
40.1 All content, trademarks, logos, service marks, and other intellectual property displayed on the SocialAngelplatform, including but not limited to text, graphics, software, photos, video, music, and sound (collectively, "Materials"), are the proprietary property of SocialAngel Services Private Limited or its licensors.
40.2 You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the platform for its intended purposes and in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the platform or the Materials without prior written consent from SocialAngel
40.3 Any unauthorized use of the platform or the Materials may violate copyright, trademark, and other applicable laws and could result in criminal or civil penalties.
40.4 If you believe that your intellectual property rights have been infringed on the platform, please notify us with adequate details at grievance@socialangel.org.
Indemnification
41.1 You agree to indemnify, defend, and hold harmless SocialAngel Services Private Limited, its directors, officers, employees, affiliates, agents, and partners from and against any and all claims, demands, liabilities, damages, losses, and expenses (including legal fees and costs) arising out of or in connection with:
Your use of or access to the platform;
Your violation of any provision of these Terms;
Your violation of any third-party rights, including intellectual property rights;
Any fraud, misrepresentation, or negligence committed by you;
Any content you post, upload, or submit to the platform;
Your conduct in connection with any campaign or donation activity.
41.2 This indemnity obligation will survive the termination or expiration of these Terms and your use of the platform.
Limitation of Liability
42.1 To the fullest extent permitted by applicable law, SocialAngel Services Private Limited and its affiliates, directors, employees, agents, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
Your access to or use of or inability to access or use the platform;
Any conduct or content of any third party on the platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;
Any content obtained from the platform;
Unauthorized access, use, or alteration of your transmissions or content;
Delays or disruptions in our services.
42.2 In no event shall the total liability of SocialAngelto you for all claims arising out of or relating to the use of or inability to use any portion of the platform exceed the amount of donation or fees paid by you to SocialAngelin the preceding 6 months before the cause of action arose.
42.3 These limitations and exclusions apply regardless of whether the damages arise from breach of contract, warranty, tort, negligence, or any other legal theory.
Electronic Delivery, Notice Policy, and Your Consent
43.1 By using the platform, you agree to receive electronically all communications, agreements, documents, notices, and disclosures (collectively, "Communications") that we provide in connection with your use of the platform.
43.2 We will provide these Communications by posting them on our website or by emailing them to the email address associated with your account.
43.3 It is your responsibility to keep your contact information up to date so that SocialAngel can communicate with you effectively.
43.4 You can withdraw your consent to receive Communications electronically by contacting us, but if you do, you may lose access to your account or certain services provided through the platform.
Dispute Resolution
44.1 In the event of any dispute, claim, question, or disagreement arising from or relating to the Terms of Use, or the breach thereof, the parties shall use their best efforts to settle the dispute. To this effect, they shall consult and negotiate with each other in good faith and attempt to reach a just and equitable solution satisfactory to both parties.
44.2 If the parties do not reach such a solution within a period of thirty (30) days, then the dispute shall be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a sole arbitrator appointed mutually by both parties. The venue of arbitration shall be Noida, Uttar Pradesh, India.
44.3 The decision of the arbitrator shall be final and binding on the parties. Each party shall bear its own costs related to the arbitration, and both parties shall equally share the arbitrator's fees, unless otherwise directed in the arbitral award.
44.4 Nothing in this clause shall prevent either party from seeking interim or injunctive relief from the competent courts of Noida, Uttar Pradesh, which shall have exclusive jurisdiction over such matters.
44.5 By agreeing to these Terms, you waive your right to participate in any class or representative action against SocialAngelServices Private Limited.
Governing Law
45.1 These Terms of Use and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India.
45.2 The competent courts at Noida, Uttar Pradesh shall have exclusive jurisdiction in respect of all matters arising out of or relating to these Terms of Use.
45.3 You agree that any dispute arising from or relating to the subject matter of these Terms shall be resolved in accordance with the provisions of Section 44 above, subject to the foregoing governing law and jurisdiction.
45.4 If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
Integration, Severability, and Waiver
46.1 These Terms of Use constitute the entire agreement between you and SocialAngelServices Private Limited concerning your use of the platform and supersede all prior agreements or understandings, whether written or oral.
46.2 If any provision of these Terms is held to be invalid, unlawful, or unenforceable for any reason, such provision shall be deemed severable and shall not affect the enforceability of the remaining provisions.
46.3 The failure of SocialAngel to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
46.4 No waiver by either party of any breach or default hereunder shall be deemed a waiver of any preceding or subsequent breach or default.

47.2 If you have any concerns or complaints regarding content or material on the platform, or any breach of these Terms of Use, you may contact the Grievance Officer in writing or via email. The complaint must include:
Your full name and contact information (address, telephone number, email address);
A description of the content or issue being reported;
Reason for objection, including any supporting documents or evidence;
A declaration that the information is accurate and that you are authorized to act on behalf of the complainant (if applicable).
47.3 The Grievance Officer shall acknowledge the complaint within 24 hours and resolve it within 15 working days from the date of receipt, in accordance with applicable laws.
Effective Date
48.1 These Terms of Use are effective as of 01 August 2025.
48.2 SocialAngelServices Private Limited reserves the right to update or modify these Terms of Use at any time without prior notice. Users are encouraged to review the Terms periodically. Continued use of the platform after changes are posted constitutes your acceptance of the updated terms.
Patient Death Policy
49.1 In the unfortunate event of the death of a patient for whom a fundraising campaign was created, the following protocols shall apply:
49.2 The Campaigner must immediately inform SocialAngelServices Private Limited via email at support@socialangel.org with the subject line "Patient Death Notification" along with valid supporting documents such as death certificate, hospital letter, or other official documentation.
49.3 Upon verification, the platform will:
Freeze any further donations to the campaign.
Evaluate pending disbursements and determine appropriate next steps.
Communicate with the Campaigner or legal representative of the deceased regarding the refund, redirection, or responsible usage of the remaining funds.
49.4 Remaining funds may be:
Refunded to donors (wherever technically and legally possible),
Utilized for pending medical bills of the deceased (on submission of valid proofs), or
Donated to another campaign or medical emergency of similar nature, subject to consent from original donors or platform policy.
49.5 All actions will be taken in compliance with Indian laws and regulations, platform integrity, donor trust, and humanitarian values. The decision of SocialAngel shall be final and binding in such cases.
Social-Kart Services
7.1 SocialAngel offers Campaigners an option to raise funds for in-kind contributions through its Social-Kart feature. This allows Donors to support campaigns by funding specific products or services instead of donating cash.
7.2 SocialAngel or its authorized procurement partners will be responsible for purchasing the listed goods or services on behalf of the Donor and delivering them to the Campaigner or beneficiary.
7.3 All goods provided under Social-Kart are:
7.4 SocialAngel will make all efforts to procure and deliver the selected items. However, in case of unavailability, alternate items of equivalent value may be offered or the funds may be used for general campaign purposes after informing the donor.
7.5 Donors opting for Social-Kart contributions acknowledge that these are non-refundable and that SocialAngel is not responsible for manufacturing defects or warranty claims, which must be resolved with the manufacturer.
